1.1 What is Goomenge.com?

Goomenge.com is a Business-to-Business (B2B) online platform designed specifically for the travel industry. A B2B portal facilitates direct interactions between businesses, enabling tour operators to advertise their tour packages to potential customers without intermediaries. Our Platform connects registered Tour Operators with customers seeking travel services by providing a digital space to showcase tour posters and contact information.

1.2 Purpose of the Platform

The Platform serves as an advertisement medium where Tour Operators can upload tour posters to promote their services. Customers visiting goomenge.com can view these posters and directly contact the Tour Operators using the provided contact details. We do not facilitate or participate in transactions, payments, billing, or any tour-related operations or disputes between Tour Operators and their customers.

  • Easy-to-Use Portal: The partner.goomenge.com portal allows you to easily upload and manage tour posters, ensuring your offerings are presented professionally to potential customers.
  • Scalable Advertising: The Platform enables you to reach a diverse customer base, helping you grow your business by attracting new clients without significant marketing investments.

3. Registration and Account Approval

3.1 Eligibility

To use the Platform, you must be a registered tour operator or a legally recognized entity engaged in providing tour and travel services. You must provide accurate, complete, and up-to-date information during the registration process, including valid business credentials.

3.2 Registration Process

  • Tour Operators must register on partner.goomenge.com by submitting details such as business name, contact information, address, and mandatory documents including:
    • GST Certificate: A valid Goods and Services Tax (GST) certificate to verify your business registration.
    • PAN Card: A valid Permanent Account Number (PAN) card of the business or authorized representative.
    • Aadhaar Card: A valid Aadhaar card of the authorized representative for identity verification.
  • Our customer care team will review and verify the submitted information and documents. Account approval is at our sole discretion and may require additional documentation or verification to ensure compliance with applicable laws and regulations.
  • Upon approval, you will receive access to your account, enabling you to upload tour posters and manage your advertisements on the Platform.

3.3 Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account.
  • You must notify us immediately of any unauthorized use of your account or any security breaches.
  • You agree to keep your account information and submitted documents updated to ensure accurate communication with customers and compliance with verification requirements.

4. Data Security and Privacy

4.1 Protection of Your Information

We are committed to safeguarding the personal and business information you provide, including your GST certificate, PAN card, Aadhaar card, and other sensitive data. We implement industry-standard security measures, such as encryption and secure servers, to protect your data from unauthorized access, disclosure, or misuse.

4.2 Use of Information

The information and documents you submit during registration will be used solely for the purpose of verifying your identity and business legitimacy, ensuring compliance with legal requirements, and facilitating your use of the Platform. We will not share your sensitive information with third parties except as required by law or with your explicit consent.

4.3 Data Retention and Deletion

We will retain your information only for as long as necessary to fulfill the purposes outlined in these Terms or as required by applicable laws. 5. Subscription Model

The Platform offers a free subscription for the first month to all registered and approved Tour Operators. During this period, you can access and use the Platform to upload and display tour posters without any subscription fees.

5.2 Future Subscription Fees

After the initial one-month free period, we may introduce subscription fees for continued use of the Platform. Any such fees will be communicated to you at least 30 days in advance. Your continued use of the Platform after the introduction of fees constitutes acceptance of the applicable charges.

5.3 No Commission (Initial Period)

For the first three months following registration, we will not charge any commission on transactions or bookings facilitated through customer inquiries generated via the Platform. After this period, we may introduce a commission structure, which will be communicated to you in advance.

6. Posting Tour Advertisements

6.1 Content Submission

Approved Tour Operators may upload tour posters and related content to advertise their services on the Platform. All content must comply with these Terms and any additional guidelines provided by us.

6.2 Content Guidelines

  • All posters and content must be accurate, lawful, and not misleading. You must not make false promises or exaggerate the quality or availability of your services.
  • Content must not contain offensive, defamatory, obscene, discriminatory, or illegal material, including but not limited to content that infringes on intellectual property rights or violates applicable laws.
  • You are solely responsible for the accuracy, legality, and appropriateness of the content you upload.

6.3 Approval of Content

We reserve the right to review, approve, or reject any content submitted to the Platform. Content that violates these Terms or is deemed inappropriate may be removed at our sole discretion without prior notice.

6.4 Direct Customer Interaction

Customers who view your tour posters on goomenge.com will contact you directly using the contact information provided in the posters. The Platform does not mediate or facilitate communication, negotiations, or transactions between you and your customers.

7. Responsibilities and Liabilities of Tour Operators

7.1 Sole Responsibility for Services

Tour Operators are solely responsible for the quality, execution, and management of the tours and services advertised on the Platform. This includes, but is not limited to:

  • Ensuring the accuracy of tour details, pricing, and availability in the posters.
  • Fulfilling all promises and commitments made to customers.
  • Providing high-quality services to avoid customer dissatisfaction or complaints.

7.2 False Promises and Bad Service

  • Tour Operators must not make false or misleading promises in their advertisements, such as exaggerated claims about tour experiences, facilities, or pricing.
  • Any instances of poor service, unfulfilled commitments, or customer dissatisfaction are the sole responsibility of the Tour Operator.
  • The Platform is not liable for any false promises, bad service, or customer complaints arising from your tours or services.

7.3 Impact of Reviews and Business Reputation

  • Customers may leave reviews or feedback about your services on external platforms or directly with you. Poor service or negative customer experiences may result in low ratings or reviews, which could adversely affect your business reputation and customer acquisition.
  • The Platform does not control or moderate customer reviews. Any impact on your business due to negative reviews or feedback is your sole responsibility.

7.4 No Involvement in Transactions

  • The Platform does not handle or process payments, issue bills, or participate in any financial transactions between Tour Operators and their customers. All payment-related matters, including pricing, refunds, or disputes, must be handled directly between you and your customers.
  • The Platform is not responsible for any issues related to tour schedules, cancellations, refunds, or customer complaints. These must be resolved directly between you and your customers.

7.5 No Liability for Disputes

We are not liable for any disputes, claims, or liabilities arising from interactions, transactions, or agreements between Tour Operators and their customers. You agree to handle all such matters independently without involving the Platform.

8. Intellectual Property

8.1 Your Content

By uploading tour posters or other content to the Platform, you grant us a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute such content solely for the purpose of advertising on the Platform.

8.2 Platform Content

All content, trademarks, and intellectual property associated with the Platform, including but not limited to the website design, logos, and branding, are owned by or licensed to Byteclock Pvt Ltd. You may not use, copy, or distribute such content without our prior written consent.

9. Termination and Suspension

9.1 Termination by You

You may terminate your account at any time by notifying us in writing. Upon termination, your access to the Platform will cease, and all your content will be removed.

9.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the Platform at our sole discretion, with or without notice, for reasons including but not limited to:

  • Violation of these Terms or our content guidelines.
  • Submission of false, misleading, or illegal content or documents.
  • Fraudulent activity or misuse of the Platform.

  • Disputes or liabilities arising from transactions or interactions between Tour Operators and customers.

The Platform is provided on an "as-is" and "as-available" basis without any warranties, express or implied.

11. Indemnification

You agree to indemnify and hold harmless Byteclock Pvt Ltd, its affiliates, officers, employees, and agents from any claims, liabilities, damages, or expenses (including legal fees) arising from:

  • Your use of the Platform.
  • The content you upload or the services you provide.
  • Any false promises, bad service, or customer disputes.
  • Your violation of these Terms or applicable laws, including the submission of false or invalid documents.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective upon posting on the Platform. We will notify registered Tour Operators of significant changes via email or through the Platform. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, India.
